Imagine owning a whopping comic book collection with great sentimental value and then discovering your mum had thrown the whole lot out. You’d be livid wouldn’t you?! Well that’s exactly what happened to this dude over in America except instead of comic books, it was a hefty porn collection that he had been collecting for years.
David Werking was so furious at his parents for throwing out his porn mags that he decided to sue them and seek compensation. Werking had moved back in with his parents for 10 months after a messy divorce before eventually moving to Indiana. Werking said his parents had no right to throw out his collection and that he had no choice but to take them to court.
Werking told the court that when he came home from work one day the boxes of X-Rated films and magazines that were worth an estimated £21,500 were missing. US district judge Paul Maloney had this to say in court:
There is no question that the destroyed property was David’s property. Defendants repeatedly admitted that they destroyed the property.
Werking’s parents counter argument said that they had a right to act as his landlords, but the judge was having none of it:
Defendants do not cite to any statute or caselaw to support their assertion that landlords can destroy property that they dislike.
Maloney ruled in favour of David Werking and his parents have now be ordered to pay their son back for the loss of his beloved porn collection. Tbf, the parents sound like a proper controlling couple of pricks. Their son is 42-years-old FFS and in the process of going through a divorce.
